SENATE BILLS
- 09-075 (42-4-109/240) Low Speed Electric Vehicles:
Effective 8/5/09. This bill assigns 0 points and further defines low speed electric vehicles.
- 09-133 (30-15-402) Traumatic Brain Injury Trust Fund:
Effective 8/5/09.
The surcharge is increased from $10 to $15.
- 09-222 (42-4-110.5) Automated Vehicle Identification Systems:
Effective 8/5/09. This bill mandates location and size of lettering required on signage.
HOUSE BILLS
- 09-1026 (42-4-1101) Low Power Scooters: Effective 8/5/09.
This assigns speeding charges/points and further defines a low power scooter.
- 09-1027 (42-4-713) Yielding ROW to Transit Buses: Effective 8/5/09.
Requires a motorist to yield to a transit bus in certain circumstances.
- 09-1090 (6-1-707) Titles Associated with Interpreteters for Deaf Persons: Effective 9/1/09.
Deceptive trade act and requirements implemented in order for an interpreter to use certain titles.
- 09-1094 (42-4-239) Cell Phone Prohibitions for Drivers: Effective 12/1/09.
For minors under the age of 18, no use of cell phones at all, no talking or texting. For drivers 18 and over, no "data use" of cell phones.
This includes texting and dialing. Exceptions are for emergency use.
- 09-1246 (42-4-1717) Monitoring Driving Schools: Specific language in this bill
did not include municipal courts therefore most municipal judges are not implementing any changes to accommodate
this bill. The law went into effect 8/5/09 but actual collection of the associated surcharge does not go into effect
until 1/1/10. Consult with your individual judges and city attorneys in order to determine how this may or may not
impact your specific local court.
- 09-1266 (42-2-125) Repeal of Loss of Driving Privileges on Certain Crimes: Effective 8/5/09.
Juveniles no longer have their license suspended for convictions on graffiti or marijuana related offenses.
First time alcohol offenses are only if they fail to complete a court ordered assessment/program. Courts should
continue to send in all MIP convictions as DMV will house the database for these violations.
